(DC Pundit) – In a jaw-dropping sequence of judicial decisions, two judges have now paved the way for an MS-13 gang member to walk free, while tying the hands of immigration authorities trying to deport him.
Kilmar Abrego Garcia, a known member of the notoriously violent MS-13 gang, was ordered released from a Tennessee prison on Wednesday by U.S. District Judge Waverly Crenshaw. This move came despite Garcia being under indictment for conspiring to transport illegal aliens across the United States, part of an ongoing human trafficking operation that prosecutors say spanned nearly a decade.
According to a federal grand jury indictment, Abrego Garcia and co-conspirators, hailing from El Salvador, Guatemala, Mexico, and the United States, were involved in smuggling illegal aliens between 2016 and 2025. He is currently facing two federal charges: one for conspiracy to transport aliens and another for unlawfully transporting them. Abrego Garcia pleaded not guilty last month, but the charges alone should’ve kept him behind bars until ICE could step in.
But that’s not what happened.
Instead, Judge Crenshaw, an Obama appointee, decided it was time for Garcia to see daylight. And before federal immigration authorities could lift a finger to detain and deport him, Judge Paula Xinis, another Obama appointee and the presiding judge in a separate civil lawsuit filed by Garcia’s wife, swooped in to block ICE from taking custody.
Yes, you read that correctly: ICE was preemptively stopped from detaining an MS-13 gang member after a federal judge released him from custody.
The Department of Justice had previously informed the court that once Abrego Garcia was released, he would be deported, not to El Salvador, but to a “third country,” though that destination remains undisclosed. That, of course, now hangs in limbo thanks to Judge Xinis’ intervention on behalf of Garcia’s wife.

It’s no secret that MS-13 has built a reputation for brutality, murders, extortion, drug trafficking, and more. And yet, here we have not one, but two federal judges deciding that the comfort and convenience of a gang-affiliated defendant outweigh public safety and immigration law.
Unfortunately, this is the modern Democratic legacy on full display: tie the hands of law enforcement, flood the country with illegal aliens, and treat criminal offenders like victims, especially if there’s political clout to gain from it.
This isn’t justice. It’s judicial activism disguised as compassion, and it’s putting the American people in danger.
