(DC Pundit) – The media and several prominent Democrats wasted no time igniting outrage over a viral incident in Minnesota, breathlessly claiming that Immigration and Customs Enforcement targeted a five-year-old child. As is often the case, the facts turned out to be far less dramatic — and far less useful for the preferred narrative. The truth is that the child was not targeted at all. He was abandoned by his own father, an illegal alien, who fled from ICE agents attempting a lawful arrest.
The January 20, 2026 incident occurred in Columbia Heights, a Minneapolis suburb. Contrary to early claims circulating online and on cable news, no witness accounts — including those critical of ICE — state that the child was alone outside before agents arrived. Every account confirms the same sequence: the child was inside a vehicle with his father when agents approached. The moment the situation became unsafe was when the father bolted on foot, leaving his five-year-old son alone in a car during freezing winter conditions. Father of the year material this was not.
An ICE officer stayed with the child to ensure his safety while other agents pursued and apprehended the father. Officers repeatedly attempted to transfer custody of the child to his mother inside the home, explicitly assuring her that she would not be arrested. She refused to take the child. The father, once in custody, requested that his son remain with him. As a result, both were transported together and are now housed in a family detention facility in Texas.

That did not stop Minnesota Democrats, including Gov. Tim Walz and Rep. Ilhan Omar, from condemning the incident as ICE “mistreating children.” Rep. Omar labeled the situation “vile” and claimed ICE was not focused on “serious criminals.” DNC Chair Ken Martin went further, falsely stating that ICE “detained a five-year-old.” Former Vice President Kamala Harris also expressed outrage over the child being in Texas. None of them mentioned the father fleeing or the mother refusing custody — curious omissions.
The White House pushed back hard, calling the claims a “horrific smear” and warning that such false narratives have contributed to a sharp increase in assaults on ICE agents. DHS spokesperson Tricia McLaughlin confirmed that when agents approached the vehicle, the father fled, abandoning his child. Agitators then arrived, yelling and blowing horns, frightening the boy. Officers responded by giving him McDonald’s food and playing his favorite music — hardly the actions of villains portrayed online.

ICE declined offers from unrelated adults to take custody, consistent with DHS policy. Agents cannot legally hand a child to unauthorized persons without verified guardianship or parental consent. DHS policy allows parents to choose whether to be removed with their children or designate a safe person — a policy consistent across administrations. The father chose to keep his son with him.
Vice President JD Vance cut through the hysteria, noting the child “was not arrested” and asking what ICE was supposed to do — “let a 5-year-old freeze to death” or ignore an illegal alien fleeing arrest. He pointed out that granting immunity to parents would effectively end law enforcement altogether.

Even attorney Marc Prokosch conceded the actions were “probably not illegal,” despite calling them cruel. Yet the only cruelty evident came from a father who abandoned his child and a mother who refused to take him. Prokosch noted the family entered the U.S. to seek asylum and had no prior criminal convictions, but pursuing a legal pathway does not equal legal status. That inconvenient detail, like so many others, was lost in the rush to manufacture outrage.
