URGENT: CLICK TO FIGHT BACK AGAINST THE LEFT!
(DC Pundit) – President Trump has been fighting an uphill battle against activist judges since the day he first took office, and this week brought yet another reminder that the judicial branch has become a favorite playground for Democrats who can’t win the argument at the ballot box.
A federal judge in Greenbelt, Maryland blocked the Trump administration Wednesday from enforcing a new executive order targeting birthright citizenship. U.S. District Judge Deborah Boardman, a Joe Biden appointee, because of course she is, issued a preliminary injunction after immigrant rights advocates asked her to step in. She had already blocked Trump’s original 2025 birthright citizenship order, so her willingness to do it again should shock absolutely no one.
Here’s the background. The U.S. Supreme Court on June 30 struck down Trump’s initial effort to end automatic citizenship for children born in the United States to parents who are neither American citizens nor legal permanent residents. The Court’s 6-3 ruling in Barbara v. Trump found the order violated the citizenship clause of the 14th Amendment, which grants citizenship to those born on U.S. soil who are “subject to the jurisdiction thereof.”
Following that ruling, Trump signed a new executive order on August 6, this one taking direct aim at “birth tourism” — the practice of foreign nationals traveling to the United States specifically to give birth and secure automatic citizenship for their children. The order would also deny citizenship to children born to parents who work for foreign governments in the United States, engage in fraud or commercial transactions to obtain citizenship, or are classified as “alien enemies.”
Reasonable stuff, most Americans would say. Judge Boardman disagrees.
She ruled that the latest order “is almost certainly unconstitutional as applied to the certified class for the simple reason that the Supreme Court in Barbara already decided that the children in the class are citizens at birth.” She then declared: “This Court must, once again, preliminarily enjoin enforcement of the President’s most recent attempt to strip the right to citizenship from them.”
Her order bars the State Department, the Department of Homeland Security, and the Social Security Administration from taking any action that would interfere with or deny citizenship to those covered by the class action lawsuit.
The 14th Amendment was ratified in 1868 primarily to guarantee citizenship to formerly enslaved people, not to create a system where foreign nationals can board a plane, have a baby on American soil, and permanently anchor their family’s immigration status. Trump is trying to address a real problem, and a Biden-appointed judge is standing in the way.
The administration will almost certainly appeal, and this fight is far from over. But if the left can’t beat Trump at the polls, they’ll settle for beating him in the courtroom, one injunction at a time.
