(DC Pundit) – A Bronx mother who stabbed her 3-year-old and 11-month-old sons and submerged their bodies in a bathtub walked out of Bronx Criminal Court Monday without a single day of prison time, and New Yorkers are left to make sense of that.
Dimone Fleming, now 26, was found not criminally responsible for the November 26, 2022 killings of her two boys. Judge Audrey Stone accepted the insanity plea, with both prosecutors and the defense agreeing that Fleming was in a state of psychosis when she committed the murders. She could be held in a psychiatric facility, for months, or years, if doctors continue to assess her as dangerous. She could also eventually walk free.

Fleming was originally charged with first-degree murder. According to court records cited by The New York Times, she stabbed both boys multiple times, placed them in the bathtub, covered their bodies with clothing and a sheet, left the faucet running, and left a stove burning. A shelter employee called 911 after water and smoke began pouring from the apartment.
Responding officers found Fleming partially naked, behaving erratically, and holding a children’s book upside down. They transported her to a hospital for psychiatric evaluation but initially failed to locate the children after being told they were with their father. Fleming’s then-boyfriend, Columbus Canada, later entered the apartment and discovered both boys unresponsive in the bathtub. Neighbors reportedly heard him screaming for help as he carried the children into the hallway. Both were rushed to a hospital and pronounced dead.

Dr. Eric Goldsmith, a psychiatrist retained by the prosecution, concluded Fleming was “grossly psychotic and out of touch with reality” — hallucinating, convinced the world was ending, and believing a spirit had entered her body. Defense-retained doctors reached the same conclusion, claiming Fleming believed she was protecting or “cleansing” her children.
Prior to the killings, Fleming had received treatment for anxiety and depression, was diagnosed with major depressive disorder, was prescribed psychiatric medication she did not take as directed, and was reportedly using marijuana daily, which doctors said worsened her condition.
Unlike the high-profile Lindsay Clancy case, this case was resolved with barely a whisper of national attention.
Bronx Assistant District Attorney Tiffany Wichman told the court: “Prosecuting mothers does not and cannot prevent these crimes from happening, but public discourse might.”
Fleming’s attorney praised prosecutors for sidestepping a murder trial altogether.
Two little boys are dead. Their father found them in a bathtub. And the system calls this justice.
Fleming returns to court September 18 for further evaluation. She is not in prison. She is not free. And those two boys are still gone.
