(DC Pundit) – Three people are dead in Salisbury, North Carolina, and the man responsible had a final order of removal sitting in his file, which means he should have been gone from this country years ago. He wasn’t, because the Obama administration decided to let him stay.
Javiel Pena Sola, an illegal alien from El Salvador, struck a vehicle on Saturday night and fled the scene. Two victims were pronounced dead at the scene. A third was airlifted to a hospital and later passed away. Sola was tracked down by a police K-9 after attempting to flee and has since been charged with three felony counts of hit and run involving serious injury or death.
This did not have to happen. Not even close.
DHS confirmed the full backstory, and it is a damning indictment of the catch-and-release policies that defined the Obama era. After his arrest for escaping from custody in Maryland in 2016, local law enforcement did the right thing, they honored an ICE detainer and handed Pena Sola over to ICE Baltimore. The system worked exactly as it was supposed to. Then the Obama administration stepped in and released him back into the country two months later.
That’s it. That’s the whole story. A dangerous illegal alien with a criminal record that included reckless endangerment, failure to stop after an accident involving damage, driving without a license, and escaping from custody was handed to federal immigration authorities, and the Obama administration put him right back on American streets.

Sola also has a final order of removal on file, meaning a federal immigration judge had already determined he needed to leave the country. He didn’t. He stayed. Three people are now dead.

ICE lodged another detainer this week and has asked North Carolina to transfer Sola to federal custody. The names of the victims have not yet been released.
Every person who defended catch-and-release, who fought ICE detainers, who blocked deportations, who treated illegal aliens with criminal records as a protected class — they own a share of what happened in Salisbury on Saturday night. The victims of this crash are not abstractions in a policy debate. They are people with families who are now left to grieve a completely preventable loss.
