(DC Pundit) – There are judicial decisions that make you scratch your head, and then there are judicial decisions that make you genuinely fear for the safety of your community. What just happened in Rhode Island falls firmly into the second category.
Bryan Rafael Gomez, a Dominican national living in the United States illegally, was arrested by ICE in Worcester, Massachusetts on April 4th after a local domestic abuse arrest triggered a background check. What that check revealed was alarming, Dominican authorities had issued a criminal arrest warrant against Gomez for homicide in 2023, and he is the subject of an active Interpol Red Notice, which is essentially an international arrest warrant for murder.
ICE detained Gomez at a facility in Rhode Island. An immigration judge issued a deportation order on April 28th. Everything was proceeding exactly as it should. And then U.S. District Judge Melissa DuBose stepped in and blew the whole thing up.
DuBose, a Biden appointee confirmed in 2024, ordered Gomez released on the grounds of “continuous unlawful detention.” ICE had argued, correctly, that Gomez was subject to mandatory detention because of the active international homicide warrant. The judge ignored that argument entirely and set a man wanted for murder free to walk the streets of America.
To make this even more infuriating, Gomez was originally caught and released at the southern border by the Biden administration back in 2022. ICE spent years tracking him down, finally located him in Massachusetts, secured a deportation order — and a Biden-appointed judge undid all of it in one ruling.
Fox News reporter Bill Melugin broke the story on X, and the details are as maddening as they sound. ICE cannot rearrest him. Thanks to Judge DuBose’s ruling, a fugitive wanted for murder by Interpol is now free to live among unsuspecting American communities.

This is the direct and predictable consequence of Biden’s open border policies combined with activist judges who prioritize the rights of criminal illegal aliens over the safety of American citizens. Every Republican in Congress should be demanding answers — loudly and immediately.
